§1 Definitions
1. Seller - ORB - ECCO-RE Tomasz Łazowski. Registered office: Powstańców 4/4, 40-040 Katowice, Poland. Registered numer: NIP: 9542493498, REGON: 240329642, e-mail: office@orbwear.pl tel: +48 606-764-618.
2. Shop - The ORB online shop is available at the address: https://www.orbwear.pl/ and is operated by the Seller, who serves as a sales platform. Through this platform, the Seller provides the functionalities of the Shop and offers services to Users, enabling distance contracts for the sale of Goods. Additionally, Users have the opportunity to familiarize themselves with the Goods available in the Shop. The Seller provides appropriate system, teleinformation, and technological tools through the Shop, to deliver the mentioned services.
3. Shop website - The website is available at the address: https://www.orbwear.pl/.
4. Terms & Conditions - This terms and conditions document specifies the terms of use of the Shop, in particular the rules for concluding contracts for the sale of Goods available in the Shop through the Shop, the rules for executing these contracts, the rules for returning Goods, and the rules for the complaint procedure.
5. User - Natural person, legal person, or unincorporated organizational unit using the functionalities of the Shop.
6. Customer - User who, in accordance with the terms set out in this regulations, has placed an order in the Online Shop.
7. Consumer - User who is a natural person entering into a legal transaction (sales contract through the Shop) not directly related to their economic or professional activity.
8. User account - Individual panel for each Customer, set up on their behalf by the Seller (after the User has registered), which collects the data provided by the Customer during the registration of the User Account (more information in the Privacy Policy.However, setting up a User Account is not mandatory to use the Shop, including browsing the Shop's assortment and placing orders.
9. Products - Sellable items available in the Shop's assortment that can be the subject of a sales contract between the User and the Seller.
10. Order - Sales contract for Goods concluded between the User and the Seller through the Shop on the terms specified in the Regulations.
§2 General terms
1. The Seller sells Goods through the Online Shop.
2. These Regulations set out the rules for the conclusion and performance of the Agreement for Sale of Goods located in the Shop and the rules for the use of the Shop.
3. Persons registering and purchasing in the online shop provide their personal data, which the Seller processes according to the principles indicated in the Privacy Policy..
4. User is obliged to use the Shop in a manner that does not interfere with its operation, consistent with the law, the provisions of the Regulations, good morals and with respect for the rights and personal property of others.
§3 Placing an order
1. Orders are accepted through the website https://www.orbwear.pl/ and for individual orders - by email (office@orbwear.pl).
2. Orders through the above mentioned website can be placed 24 hours a day, 7 days a week, all year round.
3. Prices given on the website are gross prices (including VAT) given in PLN and Euro (prices given in Euro are only approximate prices, when the order is processed the account is charged in PLN). The prices shown do not include shipping costs.
4. Price quoted on the site at the time of placing an order is the final price, binding both the Customer and the Seller. Once the order has been placed, the price of the ordered goods will not change, regardless of price changes introduced by the Seller or promotional or sales actions launched.
5. All Goods in the shop are marked in detail: in the product card of each Goods there is information on the material used, the price, as well as information on the time it takes to complete the Order.
6. The order is effective if the Customer correctly fills out the order form and correctly provides contact information including the exact address to which the Goods are to be shipped, including the telephone number and e-mail address.
7. If the data provided are not complete, the Seller will contact the Customer. If the Customer cannot be contacted, the Seller has the right to cancel the Order.
8. In the process of placing an order, the customer may wish to receive a fiscal receipt or a VAT invoice. Proof of sale will be attached to the shipped package.
9. Placing Orders made available in the Online Shop is possible:
a) after registration by completing the registration form, located on the website of the Online Shop (shopping via registration);
b) by providing the necessary personal and address data to enable the Order to be processed (purchases without registration).
10. Detailed instructions for placing orders:
- To place an order through the Shop's service, add the selected Goods to the shopping cart.
- After completing and determining all the Goods for the Order, you need to go to the "Your Cart" view, then complete the shipping data (select the country, province, city and postal code). After pressing the "Update" button, the system prompts for possible delivery options for the Order. Next, click the "Proceed to Checkout" button.
- The next step is to complete the data in the order form in the fields marked as required, create an individual account or log in to an existing one. After completing the required data (in particular, customer data, shipping data and payment method), click the "Buy and pay" button.
- Once the customer has placed a successful order, he or she will receive an automatic response from the shop confirming receipt of the Order (as well as all Order details).
§4 Delivery and order processing time
1. The Customer may choose one of the following forms of delivery of the ordered Goods:
THE TIME TO RECEIVE A PACKAGE IS THE LEAD TIME + DELIVERY TIME.
2. The shipping cost is added to the price of the Goods, depending on the selected form of delivery and payment. For orders larger than 444 PLN, shipping cost is borne by the Seller.
3. ORB reserves the right to choose the courier company performing the delivery of Goods to the Customer.
4. The availability of the goods is indicated on the website of the Shop, in the product card for each product.
- Goods with available quantity of products in stock - the lead time is 1-3 business days (Monday - Friday, excluding public holidays);
- Goods marked "on order" the delivery time is 10-21 working days (Monday - Friday, excluding public holidays);
- Individual Orders and Orders shipped internationally, the lead time is determined each time by the Seller in a separate e-mail correspondence.
5. The time required for delivery of the Order shown next to the selected form of delivery shall be added to the lead time given in the product card of each commodity.
§5 Payments
1. Each Order is accompanied by a receipt or a VAT invoice - depending on the option selected by the Customer.
2. ORB shall not be responsible for the provision of incorrect or incomplete invoice data by the Customer.
3. The Seller provides the following payment methods for an Order placed in the Shop:
- cash on delivery upon receipt of the Goods (option available only for delivery by courier a service);
- via an online payment service, confirmed with the Seller
- by bank transfer to the Shop account (the Shop provides the Customer with the transfer details in an automatically generated message after placing the order).
§6 Withdrawal from the Contract
1. The Customer has the right to withdraw from the contract of sale of Goods, without giving any reason (the so-called return of goods) within 14 days.
2. In order to exercise the right of withdrawal, the customer shall make an unequivocal statement of withdrawal from the contract by sending an e-mail to: office@orbwear.pl
3. In the event of withdrawal from the contract of sale, the Seller shall return to the Customer the payments received, including the costs of delivery of goods to the Customer (except for additional costs resulting from the method of delivery chosen by the Customer other than the cheapest ordinary method of delivery offered by the Seller), no later than 14 days from the day on which the Seller was informed of the Customer's decision to exercise the right of withdrawal from the contract of sale, subject to point 5 of this paragraph.
4. The Shop will refund the Customer to the bank account number provided by the Customer within 14 days of the approval of the return of the Products.
5. The Seller may withhold payment until the returned item has been inspected.
6. Goods returned should be in unused, new condition with no signs of use.
7. The Customer returning the Goods shall be obliged to attach to the shipment - a completed Withdrawal Form, available here.
8 Returned Goods should be sent back to the address: ORB Tomasz Łazowski, 4/4 ul. Powstańców., 40-040 Katowice within the time limit referred to in point 1 of this paragraph.
§7 Claims procedure
1. The subject of the sale are new Goods, free from defects.
2. The Seller shall be liable to the Customer for any defects to the goods purchased through the Online Shop.
3. In the case of contracts concluded with Buyers having the status of a Consumer, complaints about non-conformity of goods with the contract shall be considered in accordance with the Civil Code.
4. Before filing a complaint, it is recommended to contact the Seller via e-mail, the contact form in the "Contact Us" tab, or by phone - this will help to process the complaint more efficiently.
5. A complaint may be submitted in writing by letter to the address of the Seller or by e-mail: office@orbwear.pl. In case of exercising the right to file a complaint, the Customer shall fill in the Complaint/ Claim Form available at here. He then sends it back with the claimed Goods and the proof of purchase to the Seller's address.
7. The Seller reserves the right of a 14-day period for processing complaints from the moment of receipt of the Goods from the Customer, and undertakes to inform the Customer of the actions taken in e-mail correspondence.
§8 Technical requirements
1. In order to use the Shop, including browsing the Shop's offer, it is necessary to have a device with Internet access and an installed web browser: Internet Explorer, Mozilla Firefox, Opera, Google Chrome or Apple Safari.
2. An active e-mail account is required to place an Order.
§9 Personal data
1. In order to maintain the User's account and to conclude and perform sales contracts, as well as to perform the Seller's obligations arising from the fact of concluding sales contracts at a distance, the Seller processes the Customer's personal data, which the Customer provides voluntarily. The provision of data is voluntary, however, essential for the execution of the Order.

§10 Final terms
1. The Seller reserves the right to change the regulations of the Shop. Any change in the regulations, the Owner of the Internet Shop will notify customers by placing an appropriate announcement on the website https://www.orbwear.pl/
2. Customers who have registered with the Online Shop will be notified of the change in the terma and conditions and the possibility of accepting them at the initial login to the Online Shop, counting from the moment the new rules and regulations come into effect. Refusal to accept the regulations is tantamount to termination of the Contract for the provision of electronic services.
3. Disputes arising from the application of these Conditions and in connection with the performance of contracts concluded between the Shop and Customers, shall be considered by the Court of competent jurisdiction under the provisions of the Code of Civil Procedure, unless, in accordance with these Conditions, the disputes are resolved by out-of-court settlement.
4. The Terms & Conditions of the Online Shop are effective as of 01.02.2022.
